1. Acceptance of Terms

By downloading, installing, or using SmilePile ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

Age Requirement: SmilePile is designed for young children (ages 5-10) to use with parental supervision. Parents are responsible for curating content and managing app settings.

2. Description of Service

SmilePile is a curated photo gallery app for children that:

  • Allows parents to organize photos into "piles" (categories) for their children to enjoy
  • Provides PIN/biometric protection to prevent accidental changes while allowing safe viewing access
  • Stores all data locally on your device (no cloud sync)
  • Is available on iOS and Android platforms
  • Is free to download and use with no subscriptions or in-app purchases

3. License to Use

StackMap grants you a limited, non-exclusive, non-transferable, revocable license to use SmilePile for your personal, non-commercial purposes.

You May:

  • Install SmilePile on your personal devices (iPhone, iPad, Android phone/tablet)
  • Use the App to organize and manage your family photos
  • Uninstall and reinstall the App at any time
  • Use all features of the App for personal purposes

You May NOT:

  • Reverse engineer, decompile, or disassemble the App
  • Copy, modify, or create derivative works of the App
  • Sell, rent, lease, or sublicense the App to others
  • Use the App for commercial purposes
  • Remove or alter any copyright notices or branding
  • Attempt to access the App's source code or underlying technology

4. User Responsibilities

You agree to:

  • Use the App legally and ethically
  • Not use the App to store illegal content
  • Be responsible for backing up your own data
  • Not attempt to hack, exploit, or damage the App
  • Comply with all applicable laws and regulations

5. Intellectual Property

The SmilePile name, logo, and app are owned by StackMap. All rights, title, and interest in the App remain with StackMap.

Your Content: You retain complete ownership of your photos. SmilePile does not claim any rights to your photos. Because all photos are stored locally on your device, StackMap never has access to your photos.

6. No Warranties

SmilePile is provided "AS IS" without warranties of any kind, either express or implied. StackMap does not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • The App will meet your specific requirements

You assume all risk for using the App.

7. Limitation of Liability

To the maximum extent permitted by law, StackMap shall not be liable for:

  • Loss of data or photos (always maintain backups)
  • Device damage or malfunction
  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, or business opportunities
  • Any damages exceeding the amount you paid for the App (which is $0)

Data Backup: You are solely responsible for backing up your photos using your device's backup features (iCloud, Google Photos, local backups, etc.).

8. Indemnification

You agree to indemnify and hold harmless StackMap from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you store in the App

9. Changes to Terms

StackMap may modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date at the top of these Terms
  • Significant changes will be announced via app update notes
  • Continued use of the App after changes constitutes acceptance of the updated Terms

10. Termination

You may terminate: You can stop using the App at any time by uninstalling it from your device.

We may terminate: StackMap reserves the right to discontinue the App or deny access to users who violate these Terms.

Effect of Termination: Upon termination, you must stop using the App and may delete it from your device. Any provisions that should survive termination (such as intellectual property rights and limitation of liability) will continue to apply.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and StackMap regarding the use of SmilePile and supersede any prior agreements.
